Welcome to JNP Travel Pte Ltd (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services, including the purchase of photographic prints, digital downloads, and wall canvases produced by Justin Ng (“Photographer”) from Singapore.
By accessing or using our website (the “Site”) and/or purchasing our products or services, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our Site or purchasing our products.
1. Intellectual Property & Copyright
1.1 Ownership: All photographs, images, and related content (“Content”) featured on the Site are the sole and exclusive property of JNP Travel Pte Ltd and/or Justin Ng. The Content is protected by international copyright, trademark, and other intellectual property laws.
1.2 Limited License to Digital Downloads: When you purchase a digital download, you are granted a single non-exclusive, non-transferable, revocable license for one (1) non-commercial print usage of the image. This license permits you to create one (1) physical print from the digital file for personal use only. The digital file may not be reproduced, distributed, sold, licensed, or used to create derivative works for commercial purposes. You are not permitted to share, resell, or otherwise make the digital file available to third parties.
1.3 Wall Canvases & Physical Prints: Purchased wall canvases and physical prints are for personal, non-commercial display purposes only. You may not reproduce, distribute, modify, or resell the physical artwork or any image contained therein without prior written consent from JNP Travel Pte Ltd.
1.4 No Waiver of Rights: Nothing in these Terms constitutes a waiver of any rights to the Content held by JNP Travel Pte Ltd or Justin Ng.
2. Purchases & Payment
2.1 Product Descriptions: We strive to ensure that product descriptions, including the resolution, dimensions, and materials of our prints and digital downloads, are accurate. However, slight variations in color, size, or other attributes may occur due to display settings or material differences. Such variations are not considered defects.
2.2 Pricing & Currency: All prices are listed in SGD and may be subject to additional taxes, duties, or fees depending on your location. Prices are subject to change without notice, but changes will not affect orders already placed.
2.3 Payment Methods: We accept various payment methods as indicated at checkout. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us to charge the total amount of your purchase.
2.4 Order Confirmation: Upon successful payment, you will receive a confirmation email detailing your order. Your order is considered accepted once we have issued this confirmation.
2.5 Refunds & Exchanges: All sales are generally final. However, if your product arrives damaged or not as described, please contact us within 7 calendar days of receipt. We may, at our discretion, offer a replacement, store credit, or refund. Digital downloads are non-refundable once the file has been accessed or downloaded.
3. Shipping & Delivery (for Physical Products)
3.1 Shipping Times & Costs: Shipping times and costs vary depending on your location and the products ordered. Estimated delivery times will be provided at checkout and are only estimates. We are not liable for delays caused by customs, carriers, or circumstances beyond our control.
3.2 Customs & Duties: For international orders, you may be responsible for additional customs, duties, or import fees. Please check with your local authorities before placing an order.
3.3 Lost or Damaged Shipments: If your order is lost or arrives damaged, please contact us promptly with supporting documentation (e.g., photographs of damage). We will work with you to find a suitable resolution, which may include reprinting or refunding your order at our discretion.
4. Restrictions & Prohibited Use
4.1 Prohibited Activities: You agree not to:
Use the Content for commercial purposes without prior written consent.
Reproduce, distribute, modify, or create derivative works of the Content beyond the granted license.
Use automated tools to scrape, harvest, or collect information from the Site.
Use the Site or the Content for any unlawful or unauthorized purpose.
4.2 Termination of License: Any breach of these Terms may result in the immediate termination of your license to use the Content, without a refund, and may subject you to legal action.
5. Disclaimer of Warranties & Limitation of Liability
5.1 No Warranty: To the fullest extent permitted by law, the Site, Content, and products are provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
5.2 Limitation of Liability: To the fullest extent permitted by law, JNP Travel Pte Ltd, its directors, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Site or the purchase or use of any product, even if advised of the possibility of such damages.
5.3 No Guarantees: We do not guarantee that the Site will be error-free, uninterrupted, secure, or free from viruses or other harmful components.
6. Indemnification
You agree to indemnify, defend, and hold harmless JNP Travel Pte Ltd, its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or related to your breach of these Terms or your misuse of the Site, Content, or products.
7. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms shall be brought exclusively in the courts of Singapore, and you hereby consent to the personal jurisdiction of such courts.
8. Changes to the Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Site. Your continued use of the Site or purchase of products after the posting of revised Terms signifies your acceptance of the updated Terms.
9. Severability
If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
10. Entire Agreement
These Terms constitute the entire agreement between you and JNP Travel Pte Ltd regarding your use of the Site and the purchase and use of our products, superseding any prior agreements or understandings, whether oral or written.
